Clarification Text on Processing of Personal Data
Within the scope of Law No. 6698 on the Protection of Personal Data ("Law"), your personal data will be processed by Ünsallar Otelcilik Turizm İnşaat Limited Şirketi ("Real Car Rental") as Data Controller within the scope of car rental offers and contracts, in accordance with the law and good faith as described below.
1. Purpose and Legal Reason for Processing Personal Data:
Your personal data may be processed in accordance with the basic principles and data processing conditions regulated in the Law, by taking all kinds of data security measures and in line with the personal data processing purposes and legal reasons detailed below.
Personal data processed in order to carry out car rental, order and reservation transactions, to process cancellation requests, to carry out risk assessment, to determine rental conditions and fee, to carry out invoicing activities, to create appointments, to make offers, to provide vehicle maintenance services, to provide HGS, to provide car rental insurances, accident and damage management and additional services in line with your request, to provide tow truck and road assistance in case of breakdown and accident, to provide after-sales support services; Based on the condition that it is necessary to process personal data belonging to the parties of the contract, provided that it is directly related to the establishment and performance of the contract in accordance with subparagraph (c) of paragraph 2 of Article 5 of the Law;
Personal data processed for the purpose of reporting to authorised institutions for the performance of obligations arising from laws and relevant legislation, fulfilment of obligations to provide information and documents, identity verification, recording of communication; based on the condition that data processing is mandatory for the data controller to fulfil its legal obligation pursuant to subparagraph (ç) of paragraph 2 of Article 5 of the Law;
Personal data processed for the purpose of exercising recourse rights, collecting the fees of the services provided, making refunds, making compensation assessments, receiving requests and complaints, keeping the records that may constitute evidence in disputes for the periods specified in the legislation; In accordance with subparagraph (e) of paragraph 2 of Article 5 of the Law; based on the condition that data processing is mandatory for the establishment, use or protection of a right;
Personal data processed for the purpose of ensuring the security of company operations and vehicles, making vehicle failure notifications, recording vehicle deliveries and returns, making financial risk assessment of the customer, planning and execution of customer relationship management processes, follow-up and execution of legal affairs, execution of information security and audit processes, planning and execution of customer satisfaction activities; Pursuant to subparagraph (f) of paragraph 2 of Article 5 of the Law; based on the condition that data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject;
Your personal data processed by our company and authorised dealers through SMS, telephone, automatic dialing machines, electronic mail and similar communication channels in order to offer our company's products and services and to send commercial electronic messages with promotional and marketing content; based on the condition of "explicit consent" within the scope of paragraph 1 of Article 5 of the Law;
In case you are involved in an accident resulting in bodily harm, your health data (sensitive personal data) processed in order to provide after-sales support services; Based on the condition of "explicit consent" within the scope of paragraph 2 of Article 6 of the Law;
It may be processed.
2. Method of Collection of Personal Data:
Your personal data is obtained in all kinds of verbal, written or electronic media in order to provide the products and services offered by the Company in accordance with the above-mentioned purposes within the legal framework determined and in this context, in order for our Company to fulfil its obligations arising from the contract and the law in a complete and accurate manner. Your personal data collected for this legal reason can also be processed and transferred for the purposes specified in Articles (1) and (2) of this text within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVK Law.
3. Transfer of Personal Data:
For the purposes stated above, your personal data may be transferred to supervisory and regulatory authorities and relevant public institutions, professional associations and similar organisations and persons or organisations permitted by the provisions of the legislation, shareholders, group companies and affiliates, leasing offices, damage repair centres, insurance companies, persons and organisations from which services are received, cooperated with and support service providers in order to carry out their activities for the purposes specified in the legislation to the extent permitted by the legislation.You may submit your requests within the scope of Article 11 of the Law "regulating the rights of the data subject" to our company in writing at
